The e-commerce PROUDLY ANAMBRA is owned by FIO TECHNOLOGY LIMITED (hereinafter referred to as “we”, “our” and “us”), and is developed to make buying and selling of agro-based products easy especially for persons within Anambra State and provides the marketplace where only high quality products will be sold.

We have updated our Terms and Conditions to provide you with complete transparency into what is being set when you visit our application and how it is been used. By downloading, and using our mobile application, you are a “USER” (hereinafter referred to as “User” or “You”), and you hereby consent to our Terms of Use (hereinafter referred to as “TOU”) as a legal contract between You and Us. This agreement defines the terms of your participation as a registered vendor or buyer in the PROUDLY ANAMBRA marketplace.
If at any time you find that you do not agree with the TOU, kindly refrain from using the mobile app to buy any product or provide any products for sale in the PROUDLY ANAMBRA marketplace.
We may revise this TOU at any time without notice to you. You agree that any changes therein will be effective immediately upon posting it on this page, with an updated effective date. It is your responsibility to periodically review this TOU to be familiar with the most current version.
User Account:
Anyone may generally purchase products from PROUDLY ANAMBRA subject to these terms and conditions. Valid email addresses and phone numbers will be required for the use of the application, while additional information such as names and valid residential addresses will be requested for purchase purposes. For more information about the collection and use of data especially as it concerns the security of your personal information, please see the privacy policy further below.
Abusing Proudly Anambra:
Without limiting other remedies, we may limit, suspend, or terminate your user account(s) and access to our services, restrict or prohibit access to, and your activities on, our services, cancel bids, remove or demote or otherwise restrict the visibility of listings, delay or remove hosted content, remove any special status associated with the account, reduce or eliminate any discounts, and take technical and legal steps to keep you from using our services if:
We think that you are creating problems or possible legal liabilities for us, our users, suppliers or other third parties;
We think such restrictions will improve the security of the PROUDLY ANAMBRA or reduce our or another PROUDLY ANAMBRA users exposure to financial liabilities;
We think that you are infringing the right of third parties;
We think that you are acting inconsistently with the letter or spirit of this agreement or our policies or abuse our employees or users;
Despite our reasonable endeavours, we are unable to verify or authenticate any information you provision to us; or
You fail to make, or it is evident that you are unable to make, full payment of any fees due for our services by your payments due date.
When a buyer or seller issue arises we may consider the user’s performance history and the specific circumstances in applying our policy enforcement, and to do the right for both buyers and sellers.
Producer: Selling Your Products:
As a vendor hereunder, you may submit your products for sale via the PROUDLY ANAMBRA marketplace. The products may include agro-based products such as rice, beans, yams, eggs, etc. All products must be suitable for physical delivery……………………………………
PROUDLY ANAMBRA acts as a reseller for your products. That means that buyers are technically buying from PROUDLY ANAMBRA and not directly from the vendor. You will however retain all rights and liabilities to your products except as provided herein.
You understand that PROUDLY ANAMBRA will review your products for quality, marketability or the like. So it is your responsibility as a vendor to submit products that match truthfully what is advertised in your sales page, or else we might remove them from the market place.
PROUDLY ANAMBRA reserves the right to reject any product(s) for any reason at any time in its sole discretion. Moreover, it is to your great advantage to ensure the quality of your products. Each product will be subject to reviews and/or ratings from purchasers, which will be available and/or ratings from purchasers, which will be available and/or prominently displayed to potential buyers of your product(s) in the marketplace.
Allowed Products
PROUDLY ANAMBRA does not allow, and you agree not to, submit any products or content that contain illegal material or products that has expired. PROUDLY ANAMBRA shall use its unfettered discretion and expressly reserves the right to remove any such products, contents or materials from the marketplace, without notice and without compensation to you.
Price Of Product(S)
It is our sole duty to determine the price of every product in our marketplace.
Hosting: You understand and agree that the sales page (“sales page”) promoting the products on the market will be hosted by PROUDLY ANAMBRA.
PROUDLY ANAMBRA will make sales pages in the market place available on the internet and shall use commercially reasonable efforts to maintain the availability (i.e. uptime) of such sales pages for the consuming public. However, no guarantees of uptime are made.
PROUDLY ANAMBRA does not own or control the internet and shall have no responsibility for anytime(s) the market place or specific sales are not accessible( i.e “downtime”), even if your marketing and/or advertising efforts, product sales,
For Producers
All producers are required to register on PROUDLY ANAMBRA platform to start selling their products. We reserve the right to accept or reject the registration of any producer at any time. We also reserve the right to include an additional price–which in this case, is our profit—to the products before putting them up for sale.
Payment Of Producer:
Except as provided below for complains, investigation for product quality, return and refund challenges or fraud investigation reserve, producer will be paid 24 hours of product sale.
Currently, producers can receive payment via any Nigerian Bank Account.
Fraud Investigation:
If PROUDLY ANAMBRA becomes aware of actual fraud or suspected fraud in connection with any purchase or group of purchase related to your account PROUDLY ANAMBRA reserves the right to require a fraud investigation. If such an investigation is required, any and all earnings / commission earned on any basis may be temporarily held pending.
Return And Replacement/Refund Policy:
PROUDLY ANAMBRA reserves the right to refuse services to any person who, in PROUDLY ANAMBRA’s sole judgement, seeks refunds without justification or at an ‘unreasonable’ frequency. Buyers who repeatedly or consistently seek refunds on many products purchased, particularly where those products have been reviewed and received good rating may be deemed a serial refunder and refused further service. Any refunds outstanding will be provided and thereafter service will be refused to the account holder.
In addition, PROUDLY ANAMBRA provides a simple means of requesting refunds within the allowed money-back window for the purchased product. If a buyer refuses to follow PROUDLY ANAMBRA’s approved procedures and the agreed-upon refund periods for refunds, PROUDLY ANAMBRA reserves the right to ban the buyer from future use of PROUDLY ANAMBRA or our marketplace as a buyer or vendor and such none compliance shall be treated as waiver.
Buyer Requested Cancellation:
Buyers can request to cancel an order on PROUDLY ANAMBRA within 30 minutes of their purchase. If the order has been posted already, buyers will need to wait until they receive the item and then decide if they want to start a return.
Buyer Return Policy:
Buyers can request return for item purchased in PROUDLY ANAMBRA, if your item arrives damaged, doesn’t match the description on our page, or is the wrong item, you can return it for exchange or replacement after proper verification by us. Generally buyer can only request for an exchange or replacements of products delivered to them. This return must be done within 24hours of delivery.
Relationship With Proudly Anambra:
You understand and agree that by becoming a vendor/affiliate, no legal partnership, joint venture, or agency relationship is created between you and PROUDLY ANAMBRA. Neither you nor PROUDLY ANAMBRA is a partner, a joint venture, an agent or has any authority to obligate or bind the other. You may not represent otherwise. As a vendor, you understand that you are allowing PROUDLY ANAMBRA to sell the product(s)/content you place in the marketplace. PROUDLY ANAMBRA is a licensee or at most a distributor of your product(s)/content.

From our mobile application, you may be referred to third-party applications and or websites that are not operated by Us. We strongly advise You to review the Terms and Conditions of every site you visit as we have no control over and are not liable for such third-party content or services. If you choose to access same you do so at your own risk.
License
PROUDLY ANAMBRA grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use our application strictly in accordance with the terms of this Agreement.
Restriction
You agree not to, and will not permit others to:
License, sell, rent, lease, assign, host, outsourced or otherwise commercially exploit the application.
Modify, make derivative works of, disassemble or decrypt any part of the application.
Remove, alter or obscure any proprietary notice (including any notice of copyright or trade mark), make derivative works of, disassemble or decrypt any part of the application.

Market place access: As a buyer, you will enjoy the ease of use and convenience of high quality products in our platform.
Your purchases are backed by PROUDLY ANAMBRA 24 hours money-back guarantee. This refund guarantee also depends on the product, vendor’s desired settings for that particular product. In the case where a particular product is not covered by a money back guarantee, PROUDLY ANAMBRA will notify the potential buyer by putting a message on the sales/order page of the product.
How We Use Your Information
We use the information derived from you to:
To better improve user experience;
To administer our mobile application and site;
To develop and maintain our security;
Communicate with you;
Drive analytics; and
Track usage.
We may also seek your consent for additional uses of your information and will use it only for the purpose described to you.
Legal Disputes:
If a dispute arises between you and PROUDLY ANAMBRA, we strongly encourage you to first contact us directly to seek a resolution. Dispute shall first resort to alternative dispute resolution procedures, such as mediation or arbitration, as alternative to litigation.
Compensation
You will compensate us in full for any loss or cost, including reasonable legal fees, we incur arising out of any breach by you of this User agreement, your improper use of PROUDLY ANAMBRA’s services or your breach of any law or the rights of a third party.
Security:
The security of your information is of utmost importance to us. Hence we commit to adopting and implementing certain security measures to help secure your information from accidental loss and from unauthorized access. However, due to technological possibilities, we cannot guarantee the absolute security of your information and that unauthorized persons will not be able to beat our security systems.
Also please note that we may store and process your information in systems located outside of your home country
